Acceptance of Terms

Agreement

By accessing or using Prompt.Doctor ("the Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

Eligibility

You must be at least 18 years old and capable of forming a binding contract to use Prompt.Doctor. By using the Service, you represent that you meet these requirements.

Updates to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via email and a notice on the platform. Continued use after changes constitutes acceptance.

Accounts & Registration

Account Creation

To access certain features, you must create an account. You agree to provide accurate, current, and complete information during registration and to keep your account information updated.

Account Security

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. Notify us immediately at security@prompt.doctor if you suspect unauthorized access.

One Account Per Person

Each person may maintain only one free account. Creating multiple accounts to circumvent usage limits or access restrictions is prohibited and may result in termination of all associated accounts.

Purchases & Licensing

Framework Licenses

When you purchase a framework, you receive a non-exclusive, non-transferable, perpetual license to use the framework content for your own personal or commercial projects. You may not resell, sublicense, or redistribute the framework content itself.

Subscription Plans

Subscription plans grant access to framework content and platform features for the duration of the active subscription. Access is revoked upon cancellation or non-payment. Annual subscriptions are non-refundable after 30 days.

Refund Policy

We offer a 30-day money-back guarantee on all one-time framework purchases. To request a refund, email billing@prompt.doctor within 30 days of purchase. Refunds are processed within 5–10 business days.

Pricing

All prices are listed in USD. We reserve the right to change pricing at any time, but changes will not affect existing purchases or active subscription periods.

Generation Credits

Credit System

Certain platform features — including Sunburn™, Pure.v2™, and AI video generation — consume Generation Credits. Credits are purchased in bundles or included with Generation Plans (Spark, Studio, Director, Sovereign). Credits are non-refundable once consumed.

Generation Plans

Generation Plans are recurring subscriptions that provide a monthly credit allocation: Spark ($29/mo — 150 credits), Studio ($79/mo — 600 credits), Director ($149/mo — 2,500 credits), Sovereign ($399/mo — 12,000 credits). Unused credits do not roll over between billing periods unless otherwise stated.

Credit Consumption

Credit costs vary by feature and model. Sunburn™ Layer costs, Pure.v2™ variation runs, video generation jobs, and other AI operations each consume credits at rates disclosed at the point of use. We reserve the right to adjust credit costs with 14 days' notice.

Credit Expiration

Credits purchased as one-time top-ups expire 12 months from the date of purchase. Plan-included credits expire at the end of each billing period. Expired credits are forfeited with no refund.

No Refunds on Credits

Generation Credits are non-refundable once purchased, except where required by applicable law. If you believe credits were consumed due to a platform error, contact support@prompt.doctor within 7 days with details of the affected job.

AI Generation Tools

Sunburn™ — 7-Layer Fusion Engine

Sunburn™ is Prompt.Doctor's proprietary multi-layer AI generation system. It processes your inputs through up to 7 sequential fusion layers using third-party AI models (including Google Gemini). Access to layers is gated by your Generation Plan tier. Sunburn™ outputs are generated on-demand and are not stored permanently unless you explicitly save them.

Pure.v2™ — Variation Engine

Pure.v2™ is Prompt.Doctor's prompt variation and style refinement system, featuring Style DNA Lock™ and Cost Forecaster. Pure.v2™ generates multiple output variants from a single input. Each variant run consumes credits. Style DNA Lock™ preserves stylistic consistency across runs; enabling it may consume additional credits.

AI Video Generation

Video generation features use third-party models (including Google Veo) to produce video content from text or image prompts. Generated videos are stored in your account storage. You are responsible for ensuring your prompts and generated content comply with these Terms and applicable law. We do not guarantee the quality, accuracy, or fitness of AI-generated video for any particular purpose.

Third-Party AI Models

Our AI tools route your prompts and inputs to third-party model providers (Google, Anthropic, OpenAI, ElevenLabs, Higgsfield, and others). By using these tools, you acknowledge that your inputs are processed by those providers subject to their respective terms of service and privacy policies. Do not submit confidential, sensitive, or personally identifiable information in generation prompts.

Output Ownership

Subject to these Terms and applicable law, you own the outputs you generate using our AI tools. Prompt.Doctor makes no claim to AI-generated outputs produced through your use of the platform. However, you grant us a limited license to process and temporarily cache outputs as necessary to deliver the Service.

Prohibited Generation Uses

You may not use AI generation tools to produce: content that is illegal, harmful, or violates third-party rights; deepfakes or synthetic media designed to deceive; content that violates our community guidelines; or outputs intended to circumvent safety systems of any AI model provider.

Tutorials & Educational Content

Platform Tutorials

Prompt.Doctor publishes educational tutorials covering AI prompting, framework usage, and platform features. These tutorials are provided for informational purposes. We do not guarantee that techniques described will produce specific results with any particular AI model.

Orchestrator-Published Tutorials

Elite Orchestrators may publish tutorials on the platform. These are reviewed before publication but are the sole responsibility of the publishing Orchestrator. Prompt.Doctor does not endorse or warrant the accuracy of Orchestrator-published tutorials.

Tutorial Monetization

Tutorials may include video advertisements. By accessing tutorials, you acknowledge that pre-roll and mid-roll video ads may play. Ad revenue is shared between the platform and the tutorial's publishing Orchestrator (70% to Orchestrator, 30% to platform) where applicable.

Tutorial Content License

Tutorial content is licensed for personal learning use only. You may not reproduce, redistribute, or create derivative works from tutorial content without written permission from Prompt.Doctor or the publishing Orchestrator.

Advertising Program

Advertiser Eligibility

Businesses and individuals may apply to advertise on Prompt.Doctor through the Advertiser Program. Approval is at Prompt.Doctor's sole discretion. Advertisers must comply with our Advertising Standards, which are incorporated into these Terms by reference.

Ad Content Standards

All advertising content must be accurate, non-deceptive, and compliant with applicable advertising laws. Ads may not promote illegal products or services, contain misleading claims, target minors, or violate third-party intellectual property rights. We reserve the right to reject or remove any ad at any time.

Ad Formats

We offer pre-roll video ads (15–30 seconds, skippable after 5 seconds), mid-roll video ads (30–60 seconds, skippable after 5 seconds), and static banner ads. Video ads must meet our technical specifications and content standards. File size limits apply: 50MB for pre-roll, 100MB for mid-roll.

Billing & CPM

Advertising is billed on a CPM (cost per thousand impressions) basis. Advertisers are charged for verified impressions and clicks as tracked by our Ad Engine. Billing disputes must be raised within 30 days of the invoice date.

Ad Revenue Share

Ad revenue generated from tutorials published by Elite Orchestrators is shared: 70% to the Orchestrator, 30% to Prompt.Doctor. Platform-owned placements retain 100% of ad revenue. Revenue share payouts are subject to the Orchestrator Program Agreement.

Advertiser Liability

Advertisers are solely responsible for the content of their advertisements and any claims made therein. You agree to indemnify Prompt.Doctor against any claims arising from your advertising content.

Content & Intellectual Property

Our Content

All framework content, prompts, documentation, platform features, Sunburn™, Pure.v2™, and associated technology are owned by Prompt.Doctor, Inc. or our contributors and are protected by copyright, trademark, and other intellectual property laws.

User-Submitted Content

By submitting prompts, frameworks, tutorials, or other content to Prompt.Doctor, you grant us a worldwide, royalty-free license to use, display, and distribute that content on the platform. You retain ownership of your submissions.

AI-Generated Output

Content you generate using our frameworks, Sunburn™, Pure.v2™, or other AI tools is yours, subject to the terms of the underlying AI model providers. We make no claim to AI-generated output produced through your use of the platform.

Prohibited Content

You may not submit content that is illegal, harmful, deceptive, infringing on third-party rights, or violates our community guidelines. We reserve the right to remove any content at our discretion.

Prohibited Uses

You May Not

• Reverse engineer, decompile, or extract framework content for redistribution • Use the platform to generate spam, phishing content, or malware • Attempt to gain unauthorized access to other accounts or our systems • Scrape or systematically download platform content without permission • Use automated tools to create accounts or circumvent rate limits • Impersonate Prompt.Doctor, our team, or other users • Abuse the credit system, exploit pricing errors, or attempt to obtain credits fraudulently • Use AI generation tools to produce content that violates third-party AI model provider policies • Resell, sublicense, or redistribute AI-generated outputs in violation of underlying model provider terms

Enforcement

Violation of these prohibitions may result in immediate account suspension or termination, forfeiture of purchased licenses and remaining credits, and legal action where appropriate.

Live Sessions & Client Portal

Live Session Technology

Live sessions between Orchestrators and clients are powered by LiveKit, a third-party real-time communications platform. By participating in live sessions, you acknowledge that audio and video data is transmitted through LiveKit's infrastructure and subject to LiveKit's terms of service.

Session Recording

Sessions may be recorded with the consent of all participants. Recording consent must be obtained before recording begins. Recordings are stored in the Orchestrator's account storage and are subject to the data retention policies in our Privacy Policy.

Client Portal

The Client Portal provides clients with access to project documents, contracts, billing, and session history. Clients are responsible for maintaining the confidentiality of their portal access credentials. Prompt.Doctor is not responsible for unauthorized access resulting from a client's failure to secure their credentials.

Screen Sharing

Screen sharing functionality is provided for legitimate collaboration purposes only. You may not use screen sharing to capture, record, or transmit another party's confidential information without their explicit consent.

Disclaimers & Limitations

No Warranty

The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI outputs — including those from Sunburn™, Pure.v2™, or video generation — will be accurate, complete, or suitable for any particular purpose.

AI Output Disclaimer

AI-generated content is probabilistic and may be inaccurate, incomplete, or inappropriate. You are solely responsible for reviewing, validating, and determining the fitness of any AI-generated output before use. Do not rely on AI outputs for medical, legal, financial, or safety-critical decisions.

Limitation of Liability

To the maximum extent permitted by law, Prompt.Doctor's total liability for any claims arising from your use of the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

Indemnification

You agree to indemnify and hold harmless Prompt.Doctor, its officers, directors, employees, and agents from any claims, damages, or expenses arising from your use of the Service, your AI-generated outputs, your advertising content, or your violation of these Terms.

Termination

By You

You may terminate your account at any time from your account settings. Termination does not entitle you to a refund except as provided in our Refund Policy. Unused credits are forfeited upon account termination.

By Us

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraudulent activity, abuse of the credit system, or for any other reason with or without notice.

Effect of Termination

Upon termination, your right to use the Service ceases immediately, including access to purchased frameworks, remaining credits, and stored AI outputs. Provisions of these Terms that by their nature should survive termination will survive, including ownership provisions, warranty disclaimers, and limitations of liability.

Seller Marketplace

Seller Agreement

If you participate as a seller on the Prompt.Doctor community marketplace, you are additionally bound by our Seller Marketplace Agreement, which governs framework quality standards, revenue share, payouts, and seller conduct. The Seller Agreement supplements these Terms and is incorporated by reference.

Revenue Share

Sellers receive 70% of the net sale price of each framework purchase. Prompt.Doctor retains 30% as a platform fee. "Net sale price" means the buyer's payment after Stripe payment processing fees. Full details are in the Seller Marketplace Agreement.

Seller Responsibility

Sellers are solely responsible for the accuracy, quality, and legality of their framework content. Prompt.Doctor does not endorse or warrant any community-submitted framework. Buyers purchase community frameworks at their own discretion.

Dispute Between Buyers and Sellers

Prompt.Doctor may mediate disputes between buyers and sellers but is not obligated to do so. Our 30-day money-back guarantee applies to all marketplace purchases regardless of whether the framework is from Prompt.Doctor or a community seller.

Orchestrator Program

Program Overview

The Prompt.Doctor Orchestrator Program allows certified AI implementation specialists ("Orchestrators") to offer services, publish tutorials, and monetize their expertise through the platform. Participation is subject to the separate Orchestrator Program Agreement, incorporated into these Terms by reference. In the event of a conflict between these Terms and the Orchestrator Program Agreement on Orchestrator-specific matters, the Orchestrator Program Agreement controls.

Marketplace Levels

Orchestrators are assigned a Marketplace Level — Certified, Pro, or Elite — based on performance, client ratings, and platform activity. Marketplace Level affects visibility, feature access, and revenue share eligibility. Prompt.Doctor reserves the right to adjust Marketplace Level criteria and individual assignments at any time.

Session Payments & Stripe Connect

All session payments between clients and Orchestrators are processed through Stripe. Orchestrators must connect a Stripe account via Stripe Connect to receive payouts. Prompt.Doctor acts as the merchant of record and collects the full session payment from the client. A 20% platform fee is retained by Prompt.Doctor; the remaining 80% is automatically transferred to the Orchestrator's connected Stripe account.

Client Payments for Sessions

When you book a session with an Orchestrator, payment is required to confirm the session. Your payment is processed by Stripe and subject to Stripe's terms of service. Session bookings are not confirmed until payment is received and verified via Stripe webhook. Checkout sessions expire after 30 minutes.

Refund Policy for Sessions

Session refunds are governed by the Refund Policy Engine in the Orchestrator Program Agreement. Key scenarios: (1) Orchestrator cancels — 100% refund; (2) Orchestrator reschedules more than 14 days out and client cancels — 80% refund; (3) Client cancels before work begins — 80% refund; (4) Client cancels with less than 10% work complete — 80% refund; (5) Client cancels with 10% or more work complete — no refund.

Tutorial Revenue

Elite Orchestrators who publish approved tutorials earn 70% of ad revenue generated from those tutorials. Revenue is tracked in the Orchestrator's Ad Earnings dashboard and paid out subject to the minimum payout threshold and schedule in the Orchestrator Program Agreement.

Payout Holds

Prompt.Doctor may place a hold on an Orchestrator's payouts in cases of active disputes, suspected fraud, policy violations, identity verification requirements, or legal/regulatory requirements. Clients are not affected by Orchestrator payout holds — client refunds are processed independently.

Platform Liability

Prompt.Doctor is a marketplace platform and is not a party to the service agreement between Orchestrators and clients. We do not guarantee the quality, timeliness, or outcomes of any Orchestrator service. Prompt.Doctor's liability in connection with any Orchestrator session is limited to the platform fee collected on that transaction.

Governing Law & Disputes

Governing Law

These Terms are governed by the laws of the State of California, United States, without regard to conflict of law principles.

Dispute Resolution

Any disputes arising from these Terms or your use of the Service shall first be attempted to be resolved through good-faith negotiation. If unresolved, disputes shall be submitted to binding arbitration in San Francisco, California.

Class Action Waiver

You agree to resolve disputes with Prompt.Doctor on an individual basis only. You waive any right to participate in class action lawsuits or class-wide arbitration.
